STATEMENT OF PURPOSES AND OBJECTS
OF
DISABILITY AUSTRALIA (DA) LIMITED
1. The name of the Company is "Disability Australia (DA) Limited" hereafter called "Disability Australia".
2. Disability Australia is the Australian arm of Disabled Peoples’ International, which is people with disabilities of the world acting together for their mutual advancement. It is an organisation operating for the benefit of all people with disabilities. Disability Australia speaks for itself, uniting together all people with disabilities to ensure their access to a fully integrated lifestyle in the community and their right to attain their potential. Disability Australia affirms the statements contained in the United Nations Universal Declaration of Human Rights.
3. In pursuing its objectives Disability Australia shall be guided by the Charter of Rights of Disabled Peoples’ International which states that all people should be able to enjoy the following rights regardless of race, creed, colour, gender, religion or disability:
* The right to live independent, active and full lives.
* The right to the equipment, assistance and support services necessary
for full productivity, provided in a way that promotes dignity and
independence.
* The right to an adequate income or wage, substantial enough to
provide food, clothing, shelter and other necessities.
* The right to accessible, integrated, convenient and affordable housing.
* The right to quality physical and mental health care that promotes
one’s ability to activity participate in society.
* The right to training and employment, without prejudice or stereotype.
* The right to accessible transportation, including public transportation,
and freedom of movement.
* The right to bear or adopt and raise children and have a family.
* The right to free and appropriate public education.
* The right to equal access to and use of all businesses, facilities and
activities in the community.
* The right to communicate freely with all fellow citizens and those who
provide services.
* The right to a barrier-free environment.
* The right to a chemical-free environment.
* The right of legal representation and to full protection of all legal
rights.
* The right to determine one’s own future and make one’s own life
choices.
* The right of full access to all voting processes.
* The right to an advocate of one’s choice.
* The right to participate in the planning of mainstream and disability
specific services.
4. The objects of Disability Australia are;
4.1 To be the National Cross-disability Consumer organisation for all Australians with Disabilities and actively represent their views.
4.2 To ensure that Australians with Disabilities enjoy the rights set out in all United Nation Charters and the Charter of Rights of Disabled Peoples’ International.
4.3 To alleviate the poverty and suffering experienced by people with disabilities here in Australia by what ever financial and other means possible.
4.4 To advise Government at all levels for the implementation of policies and programs to assist people with disabilities, and advise and assist Government in that implementation
4.5 To disseminate information and provide advice to people with disabilities and their families, regarding Government, Community and Private disability services which would assist them to overcome the negative effects of disability on their lives.
4.6 To consult on matters of policy and share information with people with disabilities and their organisations.
4.7 To ensure that people with disabilities have proper and adequate representation on bodies and organisations which make decisions that affect their lives.
4.8 To encourage research and programs on disability issues, from a disability movement perspective. This research should include research into the prevention of disability.
4.9 To seek the right of considered comment on all government policies.
4.10 To represent Australians with disabilities in all forums of Disabled Peoples’ International and at all other International forums which may affect the lives of all people with disabilities.
POWERS
5.1 To seek funds to pursue the objects of Disability Australia, whether by grants, donations, subscriptions or otherwise.
5.2 To employ or engage such staff as are necessary to carry out the objects of Disability Australia upon such terms and conditions as the National Council may from time to time determine.
5.3 To purchase, sell, deal in, lease or otherwise acquire or improve any buildings or other property, real or personal.
5.4 To enter into any arrangements with any government or authority that will further Disability Australia’s objects.
5.5 To borrow, raise or secure the payment of money in such manner as Disability Australia may think fit.
5.6 To make, draw, accept and issue cheques, promissory notes, bills of exchange and other negotiable or transferable instruments
5.7 To open and operate bank accounts.
5.8 To invest and otherwise deal with the money of Disability Australia not immediately required for the purpose of carrying out the objects of Disability Australia.
5.9 To do all such things as are incidental or conducive to the attainment of the objects and powers of Disability Australia.
APPLICATION
6. The income and property of Disability Australia shall be applied solely towards the promotion of the objects of Disability Australia and no portion thereof shall be paid or transferred, directly or indirectly by way of dividend, bonus or otherwise, to the members of Disability Australia. Provided that nothing herein contained shall prevent the payment in good faith of remuneration to any officers or employees of Disability Australia in return for any services rendered to Disability Australia or for goods supplied in the ordinary and usual way of business.
DISTRIBUTION OF PROPERTY
7. If upon the winding up or dissolution of Disability Australia there remains, after satisfaction of all debts and liabilities, any property whatsoever, the same shall not be paid to or distributed among the members of Disability Australia but shall be given or transferred to some other institution or organisation having objects similar to the objects of Disability Australia and whose Rules, Memorandum of Association or constitution shall prohibit the distribution of its or their income and property among its member or their members to an extent at least as great as is imposed on Disability Australia under or virtue of these Rules. Such institution or organisation which is approved by the Commissioner of Taxation as a public benevolent institution for the purposes of any Commonwealth Taxation Act.
